Travel Refunds - Advice Appreciated
Much appreciate advice from anyone on here who is in the travel business or advice from the many WHO experts.

Have paid a sizeable deposit for a Greek cruise through a well known British travel agent. I cancelled the holiday a while back as I could see the way things were going. Company said Greek cruise company are offering vouchers valid for 18 months and if not used they will pay a full refund.

I may well want to use the vouchers but would prefer to have a full refund ie company could go bust in the meantime and vouchers would be worthless. Does anyone know if my contract is ultimately with the travel agent or the cruise company ?

I think I read recently that Italian/Greek companies are in breach of EU law and the matter is being investigated but I don't know (even if that is true) whether it impacts who my contract is actually with.

PS - Obviously I know this isn't football related so just to say we need a win tomorrow.

Just got back home so many thanks for your comments which I will digest fully this evening. I should have mentioned that I cancelled the holiday when I did so that I qualified for a full refund under the Greek company's cancellation clause ie structured refund percentages depending on when cruise cancelled.

Seems on first reading though that my contract is actually with the travel agent rather than the cruise company but if the the Greeks/Italians are not playing ball re EU rules then I am not sure where that would leave the UK travel agent. Does their ATOL/ABTA certification cover them ? Obviously I wouldn't want them to lose out.

I have already indicated that I would be prepared to accept the vouchers as I intend to take the cruise next year (all being well) but it isn't due to start until 8th September so until that date is passed then perhaps I have time to change my mind and say I don't want to accept vouchers after all. Then again, if my contract is with the UK travel agent, maybe my acceptance (or not) of the vouchers is irrelevant as it is a matter for them to take up with the cruise company.

lufthansa pulled the plugs on my flights,i got a voucher for next summer hotels paid me back my doe, booking . com i will book with them again, next summer. for friedrichaven

I had the same problem with Vueling Airlines. They tried every trick in the book to give me a voucher but I insisted on the refund. They told me it would take 8 weeks and I said fine. A few days later the money was back in my account.

Yup... you then have a leg to stand on... I'm waiting on effin' Virgin to pull the plug in September I can then move dates to next year for the Car and Villa etc with no penalties... If I cancel my Villa as of this point then I lose over a grand...

And as a point of note, as I posted upon the Holiday thread, take notice of which agents and airlines have/are playing up with the current round of refunds and book accordingly, lest it be you in the future

The problem you've got is that YOU cancelled - that generally gives you less options as it's not their problem that you decided not to go (if they offer refunds then fine, but I'm sure they won't). Secondly, certainly with airlines, once you've accepted vouchers that's your lot - you can't then change to cash refund.

Section 75 is the credit card refund extraction that Crassus refers to (it's over £100 I believe), but I don't think it will apply here because you cancelled and accepted a voucher. The contract is essentially complete.

Lesson in all of this - let them cancel. I've just had my seventh trip cancelled this morning - I've not cancelled a single thing. As Sven said, if you're entitled to a refund, demand one and don't give up. Loads of airlines couldn't give a fuck about the law, but they're falling into line eventually - I'm still waiting on an Air Malta refund from a March cancellation and after a lot of arguing with KLM they've now agreed to refund an April cancellation (no sign of it, mind you). Ryanair and easyJet agree after an awful lot of effort, but no sign of those either yet. BA took some effort but have refunded some flights (not all).

As a general point don’t give up asking for a refund.
I had trips to Australia & New York booked for April & May via Expedia and have got hotel and car refunds back by waiting for THEM to cancel.
With flights it took Virgin (NYC) & Qantas (Perth) three and four emails telling me I must accept vouchers and me telling them CASH ONLY.
Finally they have ‘discovered’ I am entitled to cash so have the NY one and the Perth refund is due in a fortnight

Lads, my thoughts - first, these are not the same issue, BK and Burns have as described, different contractual positions

BK - a couple of questions; when was the holiday due to start and by what means did you pay?

Your contract is with the agent, not the cruise operator. The agent holds a contract with the operator.

Moving on, as it reads, you cancelled the holiday, as such you are not entitled to anything but the standard T's and C's that you signed up to, the basic cancellation policy

Now if they cancelled the trip that is a different issue. They are in breach and are entitled to offer one of three things.
An alternative departure date
A voucher for a future holiday (often they offer a bonus, so 120% of that you paid)
Or are obligated if you decline the above to a full refund, this by EU law and also Abta/Atol protocol

If you paid by credit card, even a small element which I believe to be £150, you can invoke the CC company to exact the refund if they dither

Really comes down to exactly what and when the events look like

Oh and another point worth remembering, there has been a kick off on the vouchers. Many holidays are booked with FOC add ons, so you may get an upgrade room/flight/facilities but when you come to redeem your vouchers those bonuses are not included. this is quite legitimate upon the basis that they were a discretionary offer at the origin time of booking and are no longer available - plenty on Sandals type holidays caught on this

Far better in the main to take the full refund and then have a new deal when you chose to travel

Yep they are. They’ve issued the vouchers. I’ve spoken directly to the hotel and they don’t take the money from the company I booked through until you check out the hotel. As that never happened they’ve never had the money thus this company are sitting on the money.

Yes similar situation isn't it. Are the company you booked with British ? and assume it is they who have issued the vouchers not the hotel ?
